California businesses must display a number of posters and distribute updated pamphlets in order to be in compliance with federal and state laws. The 2008 Employment Notices poster must be displayed by January 1, 2008, in a conspicuous place in the workplace where all employees and applicants can see it, while pamphlets and information sheets must be distributed to employees on their hire date or when they go on leave.
2008 Poster Features The 2008 Employment Notices contains all 16 California and federal notices every California business must post, on one poster. The poster includes:
Minimum wage, federal and state; Uniformed Services Employment and Reemployment Rights Act (USERRA) military leave benefits notice; Emergency notice; Pay day notice; Safety and health (Cal/OSHA); Workers' Compensation; Discrimination and Harassment is Prohibited (DFEH); Family/medical leave, pregnancy (federal and state); Whistleblower protection; Equal employment opportunity; Time off for voting; Polygraph protection; and Unemployment Insurance (UI), State Disability Insurance (SDI), and Paid Family Leave (PFL).
Employers should be aware that even though California’s minimum wage is higher than the federal minimum wage, both minimum wage posters are required to be displayed by California employers. The CalChamber’s 2008 California and Federal Employment Poster has both.
Employers should display the poster anywhere all employees can easily read it, such as a break room, common hallway, payroll office or other common location. In addition, employers must display several of the posters (polygraph protection, and state and federal anti-discrimination posters) where job applicants can read them. Also, employers must post the poster in each company location.
Pamphlets California employers will also need to distribute new pamphlets for 2008. The 2008 Required Notices Kit includes the 2008 Employment Poster, plus 20 copies each of these pamphlets.
California employers must distribute the following pamphlets to employees: Paid Family Leave - explains notice to employees of their rights to paid family leave benefits. (new for 2008)
Unemployment Insurance - offers notice of insurance benefits in the event an employee is laid off required for all types of separation.
State Disability Insurance - provides notice of disability insurance benefits in the event an employee is injured (and the injury is not work-related) this will have a mandatory change for 2008.
Sexual Harassment Information Sheets - describes the problem and the penalties of sexual harassment.
Workers’ Compensation Rights & Benefits - gives details to employees of their right to workers’ comp benefits should they sustain an on-the-job injury.
Businesses must also be aware that if any employees are Spanish-speaking, employers may need to order the Spanish version of the pamphlets. | |
